Split decision by a single bench of the court is relatively a new trend in Bangladesh

    The senior judge of a two-member High Court bench on December 12 ruled in favour of BNP chief Khaleda Zia’s participation in the national election, but the junior judge disagreed with him. Following the split order, Chief Justice Syed Mahmud Hossain assigned another HC bench to hear and dispose of Khaleda’s three writ petitions. The High Court yesterday rejected three separate writ petitions filed by BNP Chairperson Khaleda Zia challenging the Election Commission’s decision that upheld the cancellation of her nomination papers by the returning officer.Therefore, Khaleda Zia will not be able to contest in the December 30 parliamentary election.
    In this regard, Dr. Asif Nazrul, Professor of Law, University of Dhaka said that this sort of split decision by a division bench of the court is relatively a new trend in Bangladesh. The senior judge of a two-member High Court bench ruled in favour of Khaelda, however; the junior judge disagreed; which did not happen usually in the past. It led to the decision of third judge which went against the participation of Khaleda.
