Kabir Humayun: The Supreme Court yesterday upheld a High Court order that granted six months bail to BNP Chairperson Khaleda Zia in an arson case filed under the Special Power Act 1974 in Comilla in 2015.
A four-member bench of the Appellate Division headed by Chief Justice Syed Mahmud Hossain passed ‘‘no order’’ on a government petition seeking stay on the High Court order, reports The Daily Star.
Barrister AKM Ehsanur Rahman, a lawyer for Khaleda said the HC order of bail to Khaleda Zia in the arson case will remain in force following the Supreme Court order.
He said Khaleda cannot get release from jail following the SC order as she is arrested in few other cases.
However, Barrister Kayser Kamal, another lawyer for Khaleda, said that BNP chairperson is in prison due to interference of the government.
She will come out from jail if the government does not interfere, he said.
On August 6, the High Court granted bail to BNP Chairperson Khaleda Zia for six months in the arson case.
Eight people were killed and many injured after a bus was torched in Chauddagram upazila of Comilla on February 2, 2015, during the anti-government agitation.
The next day two cases were filed with Chauddagram Police Station — one for murder and another for arson.
